Disabled should be given same benefits as given to the candidates belonging to Scheduled caste and Scheduled tribe: SC
Supreme Court said that the persons who are suffering from any kind of disability are socially backward persons and such persons are entitled to same benefit as given to the persons belonging to Scheduled caste and Scheduled tribe.
Supreme Court also heard an appeal which was filed against the decision given by the Punjab and Haryana High court. This appeal was heard by Justice Rohinton Fali Nariman and he said that he is following here decision given by Delhi High court in the case of Anmol Bhandari (minor) V Delhi technological University 2012 (131) DRJ 583. The petitioner in the case was a mentally challenged person and he had applied for the diploma course in Fine Art and this course was for physically and mentally retarded person. His motive behind filing this petition was that there should be division of the seats among mentally challenged and physically challenged candidates. He also said in petition that aptitude test of the mentally retarded person should not be taken but this petition was dismissed by Supreme Court.
When the final hearing of the appeal was going on court came to know that the seats that was kept for the mentally and physically retarded person was given to some other person. Court here said that as the candidates belonging to SC and St Category need 35% to pass in the aptitude test same shall apply to mentally and physically retarded person also
